1. Acceptance of Terms

By accessing and using Drivaro's vehicle rental services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Rental Agreement

2.1 Eligibility

To rent a vehicle, you must:

• Be at least 21 years of age (25 for luxury vehicles)
• Hold a valid driver's license for at least 1 year
• Provide a valid credit card in your name
• Present valid government-issued identification

2.2 Rental Period

The rental period begins at the time specified in your rental agreement and ends at the scheduled return time. Late returns may incur additional charges at the hourly or daily rate, whichever is greater.

2.3 Vehicle Use

The rented vehicle may only be used:

• By authorized drivers listed on the rental agreement
• For lawful purposes only
• On paved roads unless specifically authorized for off-road use
• Within the specified geographic area (typically state or country)

3. Prohibited Uses

You agree NOT to use the vehicle:

• While under the influence of alcohol or drugs
• For racing, testing, or any competitive driving events
• To transport illegal goods or substances
• To transport more passengers than the vehicle's seating capacity
• To push or tow any vehicle or trailer
• On unpaved roads (unless specifically authorized)
• For subletting or re-renting to third parties

4. Payment and Fees

4.1 Rental Charges

You agree to pay all charges including but not limited to: daily rental rate, additional driver fees, insurance options, fuel charges, tolls, parking tickets, traffic violations, and any applicable taxes.

4.2 Security Deposit

A security deposit will be authorized on your credit card at the time of rental. The amount varies by vehicle type and will be released within 7-14 business days after the vehicle is returned and inspected.

4.3 Fuel Policy

Vehicles are provided with a full tank of fuel and must be returned with a full tank. If returned without a full tank, you will be charged a refueling fee plus the cost of fuel at premium rates.

5. Insurance and Liability

5.1 Insurance Coverage

Basic insurance coverage is included with your rental. Additional coverage options (Collision Damage Waiver, Liability Insurance Supplement, Personal Effects Coverage) are available for purchase.

5.2 Your Responsibility

You are responsible for all damage to or loss of the vehicle, including damage caused by weather, road conditions, theft, or vandalism, unless you have purchased additional coverage. You are also liable for all traffic violations, tolls, and parking tickets incurred during the rental period.

6. Accidents and Damage

In case of an accident or damage to the vehicle, you must:

• Contact local authorities immediately
• Notify Drivaro within 24 hours
• Complete an accident report form
• Obtain contact information from all parties involved
• Not admit fault or liability at the scene

7. Cancellation and Refunds

7.1 Cancellation Policy

• Free cancellation up to 48 hours before pickup
• 50% refund for cancellations 24-48 hours before pickup
• No refund for cancellations less than 24 hours before pickup

7.2 Modifications

Modifications to existing reservations are subject to vehicle availability and may result in rate changes.

8. Termination of Rental

Drivaro reserves the right to terminate the rental agreement and repossess the vehicle at your expense without notice if:

• You violate any terms of this agreement
• The vehicle is abandoned or illegally parked
• The vehicle is used for illegal purposes
• Payment is declined or insufficient funds are available

9. Limitation of Liability

Drivaro's liability is limited to direct damages only and shall not exceed the total rental charges paid. We are not liable for any indirect, incidental, or consequential damages including loss of income, loss of business, or personal injury.

10. Indemnification

You agree to indemnify and hold harmless Drivaro, its officers, employees, and agents from any claims, losses, damages, or expenses arising from your use of the vehicle or violation of these terms.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction where the rental originates. Any disputes shall be resolved in the courts of that jurisdiction.

12. Changes to Terms

Drivaro reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.
